This site and the intellectual property held within are protected by copyright, trademark, and other intellectual property laws. Any unauthorized use of any trademarks, trade dress, copyrighted materials, or any other intellectual property belonging to Kowalski's or any third party is strictly prohibited and may be prosecuted to the fullest extent of the law.

3. Health and Wellness Content

Any health or nutritional information provided through our Services is for informational purposes only. While we strive for accuracy and completeness, you should always consult with your physician or other health care professional for your individual health circumstances.

4. Limitations on Use

Your use of the Site must comply with the following:

5. Text Message Programs

We offer our customers various text messaging programs, including order notifications, promotional events, and new product releases. By participating in a Text Message Program, you agree that your personal information in subject to our Privacy Policy. Message and data rates may apply.

A. Opting in to a Text Message Program

Enrollment into a Text Message Program requires you to provide your phone number and to agree to these terms. If you do not agree to these terms, we reserve the right to stop offering these programs to you.

B. Content you may receive

Some of the programs you may enroll in include:

• Notifications about your online order status
• Promotional messages from our Keep in Touch program
• Cart reminders
• Notifications about your order ahead (in-store) order
• On-Demand text message replies (e.g. texting us about your curbsite pickup order)

C. Opting Out

If you wish to stop receiving text messages from us, you may reply with "STOP" to any of our text messages to be immediately unenrolled. Your request may generate an additional message to confirm your opt-out. Texting "STOP" will not unenroll you from all of our programs, just the applicable program.

D. Changing your phone number

If you change or otherwise lose access to your phone number, you agree to notify us immediately so that we may update our records. Failure to do so is a breach of these terms. To notify us about a change or to learn more about these programs, please contact us.

6. Employment Opportunities

The Site may allow you to submit job applications through our third-party HR platform, Paycom. Use of this service is subject to both Kowalski's and Paycom's Terms of Service. You agree to submit only current, accurate and complete information for yourself and not others.
